1. Introduction

These Terms of Service ("Terms") govern your access to and use of pushthruitactivewear.com (the "Site") and any purchase you make from Push Thru It Activewear, a dba of The Kendt Collection, L.L.C. ("we," "us," or "our"). By visiting the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, and able to form a binding contract to use this Site and place an order. By using the Site, you represent that you meet these requirements.

3. Products & On-Demand Orders

Many of our products are made to order through an on-demand process. As a result:

• Product colors, sizing, and print placement may vary slightly from what's shown on the Site due to the production process

• Production and shipping timelines are estimates, not guarantees; see our Shipping Policy for details

• Because items are produced specifically for your order, our Return/Refund (Reshipping) & Exchange Policy applies to any cancellations, returns/refunds (reshipping), or exchanges

4. Orders, Pricing & Payment

All prices are listed in [USD] and are subject to change without notice. We reserve the right to refuse or cancel any order for reasons including, but not limited to: product or pricing errors, suspected fraud, or unavailability of a product. If we cancel an order after payment has been charged, we will issue a full refund.

Payment is processed securely through [Shopify Payments / Stripe / PayPal, etc.]. By providing payment information, you represent that you are authorized to use the payment method provided.

5. Order Cancellations & Changes

Because items enter production quickly, we can only accommodate order changes or cancellations within [1–2 hours] of purchase. Contact us at [careteam@pushthruitactivewear.com] as soon as possible if you need to change or cancel an order, or via our website’s Contact Us page.

6. Shipping & Returns

Shipping timelines, rates, and delivery details are described in our Shipping Policy. Return, exchange, and refund eligibility are described in our Return/Refund & Exchange Policy. Both policies are incorporated into these Terms by reference.

7. Account Registration

If you create an account on our Site, you are responsible for maintaining the confidentiality of your login information and for all activity under your account. Notify us immediately at careteam@pushthruitactivewear.com if you suspect unauthorized use of your account.

8. Acceptable Use

When using the Site, you agree not to:

• Submit false, fraudulent, or misleading information, including fraudulent payment information

Discount codes, promotions, and gift cards are subject to any additional terms stated at the time they are offered, may not be combined unless specifically stated, and may be modified, limited, or discontinued at any time. We reserve the right to cancel orders that we believe involve fraudulent or abusive use of a promotional offer.

Our Site is hosted on Shopify and may link to or rely on third-party services (such as payment processors, marketing tools, or our print-on-demand production partner). We are not responsible for the content, policies, or practices of third-party sites or services. Use of those services may be subject to their own terms and privacy policies.

Our total liability for any claim arising from these Terms or your order shall not exceed the amount you paid for the product(s) giving rise to the claim.

You agree to indemnify and hold harmless The Kendt Collection, L.L.C., Push Thru It Activewear, and its owners and employees from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

16. Governing Law & Disputes

These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles. Any dispute arising from these Terms shall be resolved exclusively in the state or federal courts located in St. Louis County, MO.

We may update these Terms from time to time. The "Effective Date" at the top of this page reflects the latest revision. Continued use of the Site after changes are posted means you accept the updated Terms.
